General Terms and Conditions of “rankworkers” for Website Creation

1. Scope of Application

These General Terms and Conditions (GTC) apply to all contracts, services, and offers provided by the Internet agency “rankworkers” (hereinafter referred to as “the Agency”) in the field of website creation and development. These GTC are mandatory for all clients (hereinafter referred to as “the Client”), regardless of their legal form.

2. Object of the Contract

The Agency offers services for the creation, development, and design of websites. The exact scope of services will be detailed in a separate contract or offer.

3. Scope of Services

The scope of services will be specified in a written contract or offer between the Agency and the Client. This includes planning, design, programming, and website maintenance.

4. Client’s Obligations

The Client agrees to provide all necessary information and materials to carry out the project in a timely and quality manner. Delays due to a lack of information or materials are the responsibility of the Client.

5. Prices and Payment Terms

The prices for the Agency’s services will be specified in a separate contract or offer. Payment terms will also be detailed in that document. Payment is usually made in multiple installments based on project milestones.

6. Liability and Warranty

The Agency is liable for damages caused by gross negligence or willful misconduct. In the case of damages caused by slight negligence, the Agency is only liable in the event of a breach of essential contractual obligations. The warranty period is 12 months from the acceptance of the website.

7. Ownership and Usage Rights

Intellectual property rights to the created website remain with the Agency until all payments are made by the Client. Once full payments are received, the Client obtains unlimited usage rights to the website.

8. Data Protection

The Agency commits to comply with current data protection regulations and treat all data provided by the Client confidentially.

9. Termination

Termination of contracts must be in writing and will be governed by the termination deadlines specified in the contract. Services already provided must be remunerated by the Client.

10. Final Provisions

10.1. Spanish law shall apply.
10.2. The place of jurisdiction for any disputes shall be Valencia.

10.3. Modifications or additions to these GTC must be made in writing.

These General Terms and Conditions are valid from [Date] and may be modified by the Agency at any time. The Client will be notified in writing of any changes. The version of the GTC in force at the time of contract formation shall apply.
